Terms of Service - Prodonto
These Terms of Service ("Terms") govern your use of Prodonto ("Platform", "we", "our", "us"). By accessing or using the Platform, you agree to be bound by these Terms.
1. Nature of Platform & Regulatory Position
Prodonto is a digital health-tech intermediary that enables discovery, connection, and coordination between patients and licensed dental professionals.
In accordance with the Telemedicine Practice Guidelines (India, 2020) and applicable laws:
- Prodonto does not provide medical or dental advice, diagnosis, or treatment.
- All clinical decisions are made solely by registered dental practitioners (RDPs).
- Teleconsultations (if enabled) must comply with applicable Indian telemedicine regulations.
- Prodonto's role is strictly limited to facilitation and technology enablement.
2. Eligibility
You agree that:
- You are 18+ or using the platform under lawful guardian supervision.
- All information provided is accurate and complete.
- You are legally competent to enter into binding agreements.
3. Compliance with Telemedicine Guidelines (India)
For Dentists (Registered Medical/Dental Practitioners)
By using Prodonto, you agree that:
- You are a licensed practitioner registered with State Dental Council/DCI.
- You will adhere to Telemedicine Practice Guidelines (2020), including patient identification and consent, appropriate case selection for teleconsultation, issuing prescriptions only when permitted, and maintaining records of consultations.
- You will not prescribe restricted drugs or violate applicable medical laws.
For Patients
- You consent to share your information for consultation purposes.
- You understand teleconsultation has limitations compared to physical examination.
- You are responsible for providing accurate medical/dental history.
4. No Doctor-Patient Relationship with Prodonto
- Prodonto does not create a doctor-patient relationship.
- Any such relationship exists strictly between the patient and the dentist.
- Prodonto is not responsible for clinical outcomes or decisions.
5. User Accounts & Verification
Patients: Must provide truthful medical and contact information.
Dentists: Must submit valid registration credentials and clinic verification details.
Users must maintain updated and accurate profile information.
Prodonto reserves the right to verify, audit, suspend, or remove accounts at any time.
6. Platform Use & Patient Allocation
Patient allocation is based on internal algorithms, including:
- Expertise
- Performance metrics
- Trust and satisfaction scores
Allocation is non-transferable and platform-controlled.
7. Strict Anti-Lead Leakage & Off-Platform Conversion Policy (Dentists)
7.1 Off-Platform Transactions
Dentists shall NOT:
- Divert or attempt to divert patients outside Prodonto.
- Share personal contact details (phone, WhatsApp, clinic address) for bypassing the platform before confirmed engagement.
- Encourage direct booking outside Prodonto.
7.2 Lead Misuse
Dentists shall NOT:
- Use patient data for marketing outside Prodonto.
- Contact patients beyond platform-approved communication channels without consent.
- Store or misuse patient data for future off-platform conversion.
7.3 Circumvention Attempts
Includes but is not limited to:
- Asking patients to cancel and rebook directly.
- Offering discounted pricing to avoid platform fees.
- Creating parallel communication funnels.
7.4 Enforcement & Penalties
Violation may result in:
- Immediate badge downgrade or visibility reduction.
- Financial penalties or recovery of losses.
- Permanent suspension or blacklisting.
- Legal action under applicable laws.
Prodonto may use behavioral analytics, audits, and patient feedback to detect violations.
8. Payments & Commercial Terms
Patients
- Treatment pricing is determined by dentists.
- Platform may enable secure payment systems where applicable.
Dentists
- Subject to conversion charge on successful conversions OR subscription plans.
- Any attempt to bypass payment obligations will be treated as fraudulent activity.
9. Performance Ranking, Badges & Incentives
Dentists are ranked based on:
- Conversion rate
- Patient satisfaction
- Ethical compliance
- Platform adherence
Rankings directly affect:
- Patient allocation
- Visibility
- Access to high-value cases
Manipulation of metrics will result in penalties.
10. Patient Safety & Ethical Conduct
Dentists must:
- Follow standard medical ethics and clinical guidelines.
- Provide transparent treatment plans and pricing.
- Avoid unnecessary or misleading procedures.
Patients must:
- Engage respectfully.
- Not misuse consultations or provide false information.
11. Cancellations, Refunds & Disputes
- Appointments must be honored or cancelled responsibly.
- Prodonto may assist in dispute resolution but does not guarantee outcomes.
- Clinical disputes remain between patient and dentist.
12. Data Privacy & Confidentiality
- All data handling complies with applicable Indian data protection laws.
- Dentists must maintain strict patient confidentiality.
- Unauthorized data use will lead to immediate action.
13. Limitation of Liability
To the maximum extent permitted by law, Prodonto is not liable for:
- Medical outcomes
- Treatment complications
- Misconduct by users
Platform liability is limited to facilitation services only.
14. Suspension & Termination
We may suspend or terminate accounts for:
- Violation of these Terms
- Breach of telemedicine or medical regulations
- Lead leakage or unethical practices
15. Intellectual Property
All platform content, branding, and systems belong to Prodonto. Unauthorized use is prohibited.
16. Modifications
We may update these Terms at any time. Continued use implies acceptance.
17. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Jurisdiction: Hyderabad, Telangana.
